TAHLEQUAH —
A Hulbert man avoided a jury trial Thursday morning when he reached a plea deal for manufacturing methamphetamine.
Woody Lee Cunningham, 39, received a 10-year sentence for manufacture of a controlled dangerous substance-possession of material with intent to manufacture. Four of those years will be suspended.
Cunningham will also be ordered to pay a $1,000 fine, $100 to the District Attorney Fund, and court costs. He was ordered to report to the Cherokee County Detention Center by Oct. 1 at 5 p.m.
Authorities alleged they went to a Hulbert-area home in January 2011 in search of stolen copper, but they found Cunningham and Timothy Jason Thompson at the home. Cunningham was reportedly shaking a plastic bottle in his right hand when officers arrived.
When he saw police, Cunningham allegedly threw the bottle away and started to go inside the home but was detained.
Thompson was found inside the residence, and was also arrested on manufacturing charges.
Thompson, 36, was set for trial this week as well, but prosecutors said the case was pushed back to another date. He has pleaded not guilty to charges of manufacture of a CDS and possession of a firearm in commission of a felony, court records show.
