TAHLEQUAH —
A Tahlequah man sentenced to 30 years in prison for first-degree manslaughter is asking for a judicial review and sentence modification.
Kent Allen Johnson, 32, was convicted last year in the 2010 shooting death of Jonathan Hall.
Prosecutors had filed murder charges against Johnson, but jurors found him guilty of a reduced charge of first-degree manslaughter.
Johnson last week filed a motion for a judicial review and modification of his sentence, saying his conviction was based on reckless handling of a firearm, which caused an “unfortunate accident.”
Johnson is asking the court to probate the remainder of his sentence.
Associate District Judge Dennis Shook on Monday set a Nov. 26 hearing on Johnson’s request and ordered the state’s Department of Corrections to compile a report on Johnson’s assessed needs, any progress he has made in addressing those needs, and any other related information.
Earlier this year, a judge denied Johnson’s request for a new trial and for his sentence to be probated in whole or in part.
Court records also show Johnson has filed a state appeal of his conviction.
