Federal grand jury indicts two alleged bank robbers

MUSKOGEE – Two men arrested after a bank robbery last month in Keys have been indicted by a federal grand jury.

James Robert Hughart, 22, and Joshua Allen Toney, 24, were indicted for bank robbery and for using, carrying and brandishing a firearm during a crime of violence.

Hughart, of Fort Gibson, and Toney, Porum, were placed on home detention with $10,000 bonds after their arrests. Federal prosecutors are appealing that ruling and asking that the two men be detained pending trial.

They are charged in connection with the Nov. 23 robbery of the Bank of Commerce at Keys. The indictment alleges they aided each other in taking money from the bank through force, violence and intimidation.

The charges stem from an investigation by the Cherokee County Sheriff’s Office and the FBI.

The bank robbery count is punishable by not more than 20 years in prison and up to $250,000 in fines. The firearm count is punishable by seven years to life in prison and up to $250,000 in fines.Assistant U.S. Attorney Dean Burris is prosecuting the case.

In another case, Michael Ray Wright, 36, was indicted for sexual exploitation of a minor child. The indictment alleges he enticed and coerced two minor children under 12 years of age to engage in sexually explicit conduct. Wright faces between 15 and 30 years in prison and up to $250,000 in fines.

That crime was also investigated by the sheriff’s office and the FBI. Assistant U.S. Attorney Edward Snow is prosecuting the case.
