Jury acquits Cooper in shooting

A Cherokee County jury deliberated for approximately 3-1/2 hours Wednesday before acquitting a man on charges of shooting with intent to kill.

Michael Allen Cooper, 34, was found not guilty of shooting into a vehicle with the intent to kill Brandy Tyer. Tyer, Jeremy Oxford, Raymond Hood and Cherokee McIntosh were in the vehicle.

District Judge Darrell Shepherd ordered one spectator out of the courtroom after she yelled out when he announced the verdict. He previously warned the spectators, who included Cooper’s family and friends as well as Tyer’s family and friends, to remain quiet when the verdict was read regardless of the outcome.

Shepherd also told Cooper’s side of the courtroom to leave after jurors left. He then told those on Tyer’s side of the room they could leave.

Cooper was alleged to have did the shooting in June.

Assistant District Attorney Josh King prosecuted the case. Crystal Jackson represented Cooper, who let out a gasp when the verdict was read.

Tyer and some of her family and friends were crying as they left the courtroom.

The alleged incident was investigated by Cherokee County sheriff’s deputies.

The use of cell phones while driving is increasingly becoming an issue. What do you think about cell phone use by emergency personnel, like law enforcement officers, EMTs, firemen, etc.?

• If the law allows the common citizen to use cell phones while driving, emergency personnel should be able to also.
• Emergency personnel should be held to a higher standard. Since they are often driving faster than normal, they should not be allowed to use cell phones while driving, even if other citizens can.
• They should be allowed to use them like anyone else, but their host entities (hospitals, fire departments, cities, etc.) should carry extra insurance for this reason.
