Two Tahlequah men were charged Wednesday with breaking into a local residence.
Jessie Dale Henley, 19, and Chad B. Russell, 18, are charged with first-degree burglary stemming from an Aug. 4 break-in of Montez Kirkpatrick’s home. Prosecutors allege the men intended to steal property.
Cherokee County court records show Henley was charged with first-degree burglary in August after an investigation by Tahlequah police. The new charges are also the result of a TPD probe.
Henley, who was represented by A.J. Garcia in the August case, pleaded no contest later that month. He was ordered to enter the Department of Corrections Regimented Inmate Discipline program under the delayed sentencing program.
He is scheduled to reappear in court in January 2010.
Court records also show Henley was charged in November 2008 with a misdemeanor count of breaking and entering a dwelling without permission.
He is on probation on that count as well.
First-degree burglary is punishable by imprisonment for seven to 20 years. Assistant District Attorney David Pierce is prosecuting the new case.
