A convicted robber was scheduled to appear in court Thursday on an application to revoke his nine-year suspended sentence, after being arrested with marijuana in his pocket on Monday.
Unfortunately for Joe Bryce Kelley, he didn’t show up for court.
Prosecuting attorney Yvette DuVall said Kelley now has a bench warrant out for his arrest for failure to appear.
At the time of his arrest this week, Kelley told Cherokee County deputies the marijuana was his “snakebite kit.”
Kelley, 24, was originally charged with robbery with a weapon. The incident occurred in 2007, when the victim, Jim Davis, agreed to meet Kelley in Welling concerning at truck Kelley has to sell. He took $4,500 cash from Davis at gunpoint.
Kelley was also charged with uttering a forged instrument. He allegedly gave a check to Oklahoma Station 2, made payable to Donna Kelley for $213.26, although he knew the check was forged, altered and/or counterfeit.
Kelley pleaded no contest to robbery with a weapon and was given credit for time served in jail. Once he was released, he was expected to report to a probation officer and pay $4,500 in restitution and court costs.
Kelley is on probation until 2017.
“He hasn’t been paying his fines and he doesn’t have a job,” DuVall said. “He has absconded.”
