Contractor charged with embezzlement

STILWELL – A Park Hill contractor was charged this week in Adair County District Court with embezzlement.

Timothy Alex Potts, 51, was charged with a felony count of embezzlement for allegedly taking $12,194.03 belonging to Carl and Dusti Asbill.

The money was given to Potts under a contract he entered with the Asbills for construction work. The money was to be paid to Potts as compensation for work performed and in trust for payment of all lienable claims due now and during the remainder of the construction contract’s duration.

Prosecutors say Potts took converted the money to his own use and benefit, without doing the work for the Asbills.

The charge was filed after an investigation by the district attorney’s office.

Embezzlement is punishable by imprisonment for no more than five years and a fine not to exceed $5,000 and restitution. Assistant District Attorney Lawrence Langley is prosecuting the case.

Potts will appear before a judge later.
