Man fails mandated treatment program

TAHLEQUAH — A Tahlequah man who was given a five-year suspended sentence on first-degree burglary charges last year was arrested this week after failing a court-ordered treatment program.

Shawn Paul Prosser, 18, was accused of going into a home and stealing a Playstation game console, then having someone else sell the equipment for $70 at a local business.

Prosser allegedly confessed his part to authorities, and pleaded guilty in exchange for the five-year deferred sentence, along with 120 days in the Cherokee County Detention Center, with credit for the time he had served before the plea.

Prosser was then ordered to enter inpatient drug treatment for one year. On Jan. 3, Faith Based Therapeutic Community Corp. of Fort Gibson sent a letter to a Cherokee County judge, explaining Prosser had been fired from his job.

Prosser allegedly told employees at the treatment center he was sick and could not work, but when he was later taken to a medical facility, he told the doctor he wasn’t sick but just didn’t feel like working anymore.

The letter explained Prosser was then told to turn his phone in to officials at the treatment facility, but he had burned his phone’s SIM card and destroyed the battery.

The letter explained Prosser will not comply with rules or instructions of the program, and has “no respect for authority.”

He was given a program failure on Jan. 4, according to the letter.

A judge ordered a $5,000 bond on Prosser’s arrest. He has pleaded not guilty and is set for a court appearance Jan. 23 at 9 a.m. in Cherokee County District Court.
