TAHLEQUAH —
A Tahlequah man received a three-year deferred sentence Wednesday as part of a plea agreement on charges of child neglect, while a similar charge against his wife was dismissed.
James A. Cosby, 23, entered the plea agreement, while 23-year-old Ashley N. Cosby had her charge of child neglect dismissed.
Both had been arrested and charged last year after their baby ingested marijuana.
Aside from the child-neglect charge, James A. Cosby was also accused of possessing a controlled dangerous substance and obstructing an officer.
Police said the Cosbys’ 1-year-old baby was taken to a Tahlequah hospital in October and was later transferred to Tulsa. Medical personnel told police the child had ingested tetrahydrocannabinol, or THC.
Reports filed in the case allege James A. Cosby first told police the child had been with someone else the day the marijuana was ingested, but when detectives went to the Cosbys’ home the next day, it reeked of pot.
James later took authorities to a bag of marijuana that was under a bathroom sink, near the child’s bedroom. Police were eventually told the couple smoked marijuana in their home and some of it might have been left behind on the living room floor, where the child could reach it.
