Woman charged with having pot in county jail

TAHLEQUAH — Prosecutors have charged a Tahlequah woman after she was allegedly caught with marijuana inside the Cherokee County Detention Center.

Amy M. Lowry, 30, is formally charged with possession of a controlled dangerous substance in a county jail.

According to an affidavit filed with the charges, CCDC officers were called to a jail cell on Dec. 30, 2012, and were told two female inmates – Lowry and Malana M. Castillo – had marijuana, and that Lowry was seeking someone who might have a lighter.

Lowry was standing in the shower, according to an officer’s report, and was stuffing something down the drain with her finger. Officers said they found a rolled-up cigarette with a green, leafy substance in the drain by Lowry’s feet.

Lowry allegedly told CCDC officers she found the marijuana “joint” in a room near a toilet when she was being placed into jail clothes.

While officers dealt with Lowry in a booking area at the detention center, Castillo began to say her toilet was clogged and that she needed a plunger, according to one officer’s report. Officers said they checked the plumbing “chase,” a space between walls where pipes are located, and found a white baggy. This plastic bad had been flushed, allegedly by Castillo, who was trying to get rid of evidence while officers were searching Lowry.

Castillo has not been charged as a result of the incident.

Court records show Lowry was charged last June with obstructing an officer and public intoxication.

Castillo was charged in Cherokee County District Court several times last year with charges including knowingly concealing stolen property, possession of a controlled dangerous substance, public intoxication, possession of a cell phone or electronic device in a penal institution, and exploitation of an elderly person.
